1. SPONSOR: Nestlé USA, Inc., 1812 N. Moore Street, Arlington, VA 22209.
2. SWEEPSTAKES PERIOD: The Essentia® Hydroboost VIP Tour Sweepstakes (the “Sweepstakes”) begins on March 12, 2024 at 12:01:00 AM Eastern Time (“ET”) and ends on April 26, 2024 at 11:59:59 PM (ET) (the “Sweepstakes Period”).
3. ELIGIBILITY: The Sweepstakes is open to legal United States residents in the fifty (50) United States and District of Columbia who are twenty-one (21) years of age or older at the time of entry. Employees, officers, and directors of Nestlé USA, Inc. (“Sponsor”), its parent company, or any of their respective affiliates, subsidiaries, advertising and promotion agencies, or any other company or individual involved with the design, production, execution or distribution of the Sweepstakes (collectively, "Sweepstakes Entities"), and each of their respective immediate family members (e.g., spouse, parent, child, sibling, and their respective spouses and the “steps” of each, regardless of where they reside) and persons living in the same household of each, whether or not related, are not eligible to enter or win.
The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Participation constitutes each entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to this Sweepstakes.
4. HOW TO ENTER: During the Sweepstakes Period, you may enter by going online to HydroboostExperience.EssentiaWater.com (“Website”) and following the instructions to provide your first name, last name, zip code and email address, and click “ENTER NOW (“Entry”).
Limit one (1) Entry per person/email address during the Sweepstakes Period. No automated entry devices, bots and/or other programs and/or software are permitted for entry. All Entries become the sole property of Sponsor and will not be returned. Sponsor is not responsible for lost, late, illegible, incomplete, invalid, unintelligible, misdirected, technically corrupted or garbled Entries, or Entries submitted in a manner that is not expressly provided herein, and all such Entries shall be deemed void and ineligible for inclusion in the Sweepstakes. Sweepstakes Entities shall not be responsible for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the processing of the Entries in the Sweepstakes; or for problems of any kind, whether mechanical, human or electronic. Sweepstakes Entities assume no responsibility or liability for any error, omission, interruption, deletion, theft or destruction, or unauthorized access to, or alteration of Entries. Only fully completed Entries are eligible.
Entrants who do not follow all of the instructions herein, do not provide the required information on the entry form, and/or do not abide by these Official Rules or other instructions of Sponsor may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification The potential winning Entry is subject to verification by Sponsor or its designee, whose decisions are final and binding. Any Entry that occurs after the system has failed for any reason is deemed a defective Entry and is void and will not be honored.
Sponsor is not responsible for any change of mailing address, email address and/or telephone number of entrants. In the event of a dispute over the identity of an entrant in the Sweepstakes, participation will be deemed completed by the authorized account holder of the email address provided at the time of participation. “Authorized account holder” is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, wireless carrier, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. The potential winner may be required to provide Sponsor with proof that he/she is the authorized account holder of the email address account associated with the winning Entry. If a dispute cannot be resolved to Sponsor’s satisfaction, the affected Entry will be deemed ineligible.
5. GRAND PRIZE: One (1) Grand Prize is available. Grand Prize consists of a 3-night trip for Grand Prize winner and one (1) guest to a VIP Tate McRae concert experience in Woodinville, Washington. Grand Prize includes: round-trip coach air transportation for Grand Prize winner and one (1) guest between a major commercial airport close to the Grand Prize winner’s primary U.S. residence (as selected by Sponsor in its sole discretion) and Seattle, WA; stipend for ground transportation to/from hotel-concert venue (to be awarded in the form of a $500 check for Grand Prize winner only), standard double-occupancy hotel accommodations selected by Sponsor consisting of one (1) room for three (3) nights; $400 for miscellaneous travel expenses (to be awarded in the form of a check to the Grand Prize winner only); two (2) concert tickets to the Tate McRae concert scheduled for July 7, 2024 at the Chateau Ste. Michelle Winery in Woodinville, WA, a meet & greet for Grand Prize winner and guest with Tate McRae at the concert and a one (1) year supply of Essentia® Hydroboost Water (to be awarded in the form of 375 coupons / ARV up to $2.50 each). Total Approximate Retail Value (“ARV”) of Grand Prize $6,521. Guest of Grand Prize winner must be 21 years of age or older. Trip must be taken from July 5, 2024 – July 8, 2024 or Grand Prize will be forfeited in its entirety. Certain restrictions may apply. Travel arrangements must be booked by Sponsor or its designee. Coupons expire 2/01/2025. Terms and conditions apply to use of coupons.
Grand Prize Trip Terms and Conditions. Grand Prize Winner and guest must depart/return from the same airport and travel on same itinerary. Trip does not include taxes, meals, tips, gratuities, service charges, hotel room service, laundry service, alcoholic beverages, merchandise, souvenirs, local and long-distance telephone calls, airport charges, or any other service or item not specifically described above. Trip is not redeemable for cash. Actual retail value of Grand Prize may vary depending on location of Grand Prize winner’s residence and may fluctuate due to market conditions, or changes in value of components, (e.g. air transportation and hotel rates) or other reasons and the difference in value will not be awarded. If Grand Prize winner lives within two hundred fifty (250) miles of Woodinville, WA, Sponsor may substitute air transportation with alternate transportation between Grand Prize winner’s residence and hotel, and the difference in value will not be awarded. No cash equivalents, substitutions or transfer of Grand Prize permitted except that Sponsor reserves the right to substitute a prize of equal or greater value. Meet & greet is subject to Tate McRae’s availability. In the event any scheduled event associated with the Grand Prize and/or any other component of the Grand Prize is cancelled, delayed, or postponed for any reason outside the control of the Sponsor, Sponsor will have no further obligation, other than to award the remainder of the Grand Prize. Sponsor and winery hosting the concert reserve the right to remove or to deny entry to Grand Prize winner and/or guest who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the venue. Sweepstakes Entities will not be responsible for weather conditions, health and safety conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any activities associated with any part of the Grand Prize. Grand Prize winner will receive an Internal Revenue Service Form 1099 for the actual retail value of the Grand Prize for the tax year in which the Grand Prize was awarded . Odds of winning depend on total number of eligible Entries received. All applicable federal, state and local taxes on Grand Prize is the sole responsibility of the Grand Prize winner.
6. DRAWING / WINNER NOTIFICATION: On or about April 29, 2024, Sponsor will randomly select one (1) potential Grand Prize winner from among all eligible Entries received during the Sweepstakes Period. Potential Grand Prize winner will be notified at the email address provided at time of Entry. Sponsor shall have no liability for any winner notification that is lost, intercepted or not received by potential Grand Prize winner for any reason. If, despite reasonable efforts potential Grand Prize winner does not respond within forty-eight (48) hours of the first notification attempt, or if the prize notification is returned as unclaimed or undeliverable to potential Grand Prize winner, potential Grand Prize winner will forfeit Grand Prize and an alternate potential Grand Prize winner may be selected. Sponsor, in its sole discretion, will attempt to contact up to two (2) potential alternate Grand Prize winners in accordance with the above procedure, after which the Grand Prize may go unawarded if it remains unclaimed. If potential Grand Prize winner is found to be ineligible, or has not complied with these Official Rules or declines the Grand Prize for any reason prior to award, Grand Prize will be forfeited and an alternate potential Grand Prize winner may be selected.
Potential Grand Prize winner will be required to sign and return an Affidavit of Eligibility, Liability Release and, where legally permitted, Publicity Release ("Winner’s Release") which must be received by Sponsor’s representatives, within seven (7) calendar days of the date notice or attempted notice is sent, in order to claim Grand Prize. The potential Grand Prize winner will also be required to execute and return an IRS Form W-9 (and will receive a subsequent 1099 IRS Form for the actual retail value of the prize). Guest of Grand Prize winner must sign and return a Liability/Publicity Release prior to ticketing. Potential Grand Prize winner may be required to provide proof of identification and complete a background check, as required by Sponsor at its sole discretion, prior to awarding of Grand Prize.
Potential Grand Prize winner will not be declared an official winner unless and until all documentation that Sponsor may require is properly executed and returned as directed by Sponsor. If potential Grand Prize winner cannot be contacted, fails to sign and return the Winner Release or provide any other requested information within the required time period, the potential Grand Prize winner forfeits Grand Prize and an alternate potential Grand Prize winner may be selected from the remaining eligible Entries, at Sponsor’s sole discretion. All taxes (including, without limitation, state and federal income taxes) and the reporting consequences thereof associated with the use and acceptance of Grand Prize are solely the responsibility of Grand Prize winner.
7. PUBLICITY GRANT: By submitting an Entry, each entrant agrees to allow use of their name, likeness, city and state of residence, and/or biographical information for promotional purposes (including posting on Sponsor’s website), in any and all media, now or hereafter known, worldwide in perpetuity, without additional compensation or notification to, or permission from, entrant, except where prohibited.
8. ENTRY CONDITIONS AND RELEASE: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries, comments, email, or other communications of any kind; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the Grand Prize or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer or other device related to or resulting from participating in this sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes at any time and for any reason, including, but not limited to, should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, and, if terminated, at its discretion, select the potential winner from among all non-suspect, eligible entries received up to time of cancellation or as otherwise deemed fair and appropriate by Sponsor. Entrants, by participating, agree that Sweepstakes Entities, and their respective parent, affiliates, subsidiaries, prize suppliers, and advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of Grand Prize, or any Grand Prize element, or participation in this Sweepstakes.
9. DISPUTES/GOVERNING LAW: Each entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, other than those concerning the administration of the Sweepstakes or the determination of winners or for any disputes arising from the loss or injury from the redemption of Grand Prize, shall be resolved individually, without resort to any form of class action; (ii) any disputes arising out of these Official Rules (except for any disputes arising from the loss or injury from the use of Grand Prize) shall be submitted to final, binding arbitration conducted in Arlington County, VA under the Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services Inc. before a single, neutral arbitrator who is a former or retired Virginia state or federal court judge who shall follow Virginia law and the Federal Rules of Evidence and have no authority to award punitive damages. Either party may enforce a final arbitration award in any court of competent jurisdiction in Arlington County, VA including an award of costs, fees and expenses incurred in enforcing the award. Notwithstanding the foregoing, Sweepstakes Entities shall be entitled to seek injunctive relief (unless otherwise precluded by any other provision of these Official Rules) in the state and federal courts of Arlington County, VA. Any dispute or portion thereof, or any claim for a particular form of relief (not otherwise precluded by any other provision of these Official Rules), that may not be arbitrated pursuant to applicable state or federal law may be heard only in a court of competent jurisdiction in Arlington County, VA; (iii) any and all claims, judgments, and awards shall be limited to actual out-of- pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys' fees; and (iv) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Virginia, without giving effect to any choice of law or conflict of law rules (whether of the State of Virginia or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Virginia.
10. PRIVACY: Information provided by you for this Sweepstakes is subject to Sponsor’s privacy policy: https://privacy.nestleusa.com/ as applicable. If you are selected as Grand Prize winner, your information may also be included in a publicly available winner’s list.
11. SWEEPSTAKES WINNER’S’ NAME:For name of the Grand Prize winner, send a request via email to [email protected]. Winner’s name to be available after May 20, 2024. Winner’s name requests must be submitted by July 20, 2024.
